Fubara was charged in the statement of enlisting Senior Advocates, such as Femi Falana, to distort court decisions. We want Mr. Femi Falana SAN to refrain from misinterpreting judicial rulings. It is unfortunate that a highly experienced attorney of his caliber would be spreading lies from political operatives and non-attorneys,” the MPs stated.
Falana allegedly misrepresented the decision of Justice J.K. Omotosho and the reported 27 MPs’ defection, which they assert never occurred. “Falana intentionally misled the public by lying about the dates of Justice J.K. Omotosho’s ruling and the alleged defection that never happened,” the statement continued.
“The Court of Appeal’s and the Supreme Court’s affirmation of Justice J.K. Omotosho’s ruling is effective immediately and indefinitely. The caucus declared that any attempt to engage with any other individual or forum as the Rivers State House of Assembly is in violation of the Supreme Court’s verdict, and that it would be considered contempt of court if the decision was not followed.
They also questioned the validity of Fubara’s recent appointments and accused him of meddling in legislative affairs. Speaker Amaewhule declared, “All those parading themselves as commissioners, permanent secretaries, and civil servants are impostors, as they have not been screened and confirmed by the Assembly.”
He cautioned that the governor’s management of public monies would soon be questioned. We are not asleep, and the governor need to be aware of it. We are aware that hundreds of billions of tax payers’ funds are currently missing and unaccounted for. He said, “There will be a day of reckoning. However, Joseph Johnson, the Rivers State Commissioner for Information and Communications, quickly brushed the lawmakers’ assertions off as false.
According to Johnson’s assertion in a statement titled “Setting the Records Straight on the Situation in Rivers,” Amaewhule and his group were no longer members of the legislature after switching from the Peoples Democratic Party to the All Progressives Congress on December 11, 2023. Johnson stated, “Martin Amaewhule and his group of 27 remain ex-members of the House of Assembly of Rivers State and their status is unaffected by the Court of Appeal’s affirmation of Justice Omotosho’s judgment.”
He said that their seats were automatically forfeited as a result of their defection. “Voluntary defection/cross-carpeting on the House of Assembly floor in full public view on December 11, 2023, resulted in the loss of seats for Rt. Hon. Martin Amaewhule and 26 other individuals in the Rivers State House of Assembly.”
Additionally, Johnson emphasized that Governor Fubara was still upholding the law and had no plans to honor those who were no longer in legislative office. Because he is a law-abiding and peaceful man, Rivers State Governor His Excellency Sir Siminalayi Fubara has a high regard for the Nigerian judiciary and the court of law.
