Attorneys have expressed concern about the serious hazards that transgender women who will now be sent to male jails may face.
Lawyer Moira Meltzer-Cohen states “It’s going to be extremely dangerous.” Fearing a possible “bloodbath,” Meltzer-Cohen, who is the attorney for Donna Langan, a transgender woman serving a life sentence for bank robbery, voiced worries for her client’s and others’ safety. According to the executive decree, only the male and female sexes would be recognized by the federal government.
As a result, biological sex—rather than gender identity—will henceforth be the sole determinant of entry to private settings like jails and shelters. A federal public defender in Massachusetts brought attention to the predicament of a transgender prisoner in Minnesota, according to DailyMail.com. The defense, Sandra Gant, explained that the inmate was “terrified” when she was suddenly told of the relocation.
In a statement shared among public defenders, Gant stated, “Her family reached out in a panic.” She and other inmates at FCI Waseca have been segregated as of this morning and informed that they will be sent to a transfer center before being sent to a men’s jail. In order to oppose the policy, Gant sought for help or insights, especially from groups like the ACLU.
Along with the modifications to jail regulations, Trump’s decree repealed a number of transgender rights. The regulation requires the use of “sex” rather than “gender” in official documents and prohibits federal funding for transition-related services.
